Introduction

 

Welcome to REDLINE Fire Watch, a company with registered office location at 8270 Woodland Center Blvd, Tampa, FL 33614 and with Employer Identification Number (EIN) 33-3189551. These Terms and Conditions (hereinafter referred to as the “Terms”) govern your access to and use of the REDLINE Fire Watch reporting system (hereinafter referred to as the “App”).

 

By using the App, you acknowledge that it serves as a fire watch compliance and reporting tool designed to support REDLINE Fire Watch, its clients, and local Authorities Having Jurisdiction (AHJs) in meeting NFPA fire watch requirements. 

 

By creating an account or using the App, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use immediately. 

 

  1. Definitions
    • “App” refers to the REDLINE Fire Watch platform, a digital reporting and compliance tool for fire watch requirements.
    • “User” refers to any individual or entity accessing or using the App, including Fire Watch Personnel, Redline Management, and AHJs.
    • “Fire Watch Personnel” refers to individuals assigned by REDLINE Fire Watch to conduct fire watch duties, document activities, and submit compliance reports through the App.
    • “Manager” refers to authorized personnel from REDLINE Fire Watch management, responsible for overseeing fire watch operations, reviewing reports, and ensuring compliance. 
    • “AHJ (Authority Having Jurisdiction)” refers to fire marshals, inspectors, or other regulatory officials responsible for ensuring NFPA compliance.
    • “Client” refers to property owners, facility managers, or businesses that contract with REDLINE Fire Watch for fire watch services.
    • “Content” refers to any text, photos, reports, notifications, or other data submitted through the App.

 

  1. Purpose and Scope
    • The App is not a scheduling or management system, but a reporting platform designed to:
      • Ensure compliance with NFPA fire watch regulations.
      • Provide real-time documentation of fire watch activities for REDLINE Fire Watch, clients, and AHJs.
      • Support transparency and accountability in fire watch operations.
    • Limitations of Use:
      • The App does not replace the legal obligation of property owners or clients to maintain compliance with NFPA and local fire codes.
      • REDLINE Fire Watch is not responsible for any regulatory violations caused by the failure of a client or AHJ to take appropriate action based on the reports provided.
      • Users are responsible for ensuring all reports are accurate and submitted in a timely manner to meet regulatory requirements.

 

  1. User Responsibilities
    • Fire Watch Personnel Must:
      • Use the App solely for logging fire watch activities and submitting compliance reports.
      • Provide accurate and complete documentation of all fire watch patrols, including timestamps, locations, and incident reports.
      • Comply with all NFPA guidelines and local AHJ requirements.
    • Redline Management Must:
      • Monitor and review submitted reports to ensure compliance with fire watch regulations.
      • Communicate with clients and AHJs regarding fire watch status, compliance issues, and required corrective actions.
      • Maintain system security and user access to protect data integrity.
    • AHJs May:
      • Access submitted reports for compliance verification and audits.
      • Use the App to review incident documentation and verify adherence to NFPA fire watch protocols.
    • Users Must Not:
      • Use the App for personal, unauthorized, or noncompliant purposes.
      • Submit false, misleading, or incomplete reports.
      • Tamper with timestamps, falsify records, or interfere with compliance tracking.
      • Share login credentials or grant unauthorized access to reports.

The User hereby concurs and acknowledges that failure to comply with any of the aforementioned conditions may result in account suspension or legal liability.

 

  1. Data Collection & Reporting Features
    • Clock in/Clock out and Location Tracking
      • The App utilizes GPS tracking to document fire watch patrols, geofence monitoring, and shift compliance.
      • By using the App, users explicitly consent to the collection and use of location data during active fire watch shifts for verification purposes.
    • Report Submission & Incident Documentation
      • Fire Watch Personnel must upload photos, logs, and incident reports as required by NFPA compliance standards.
      • Submitted reports are stored securely and may be accessed by Redline Management and AHJs for compliance verification.
    • Notifications & Compliance Alerts
      • The App facilitates automated notifications to Redline Management and AHJs regarding missed patrols, expired compliance periods, or potential violations.
      • Users may receive reminders for required documentation submissions. 

 

  1. Confidentiality & Data Protection
    • Users agree to maintain the confidentiality of all fire watch reports, incident documentation, and regulatory communications submitted through the App.
    • The App follows industry standard security measures to protect stored data, but REDLINE Fire Watch does not guarantee against data breaches beyond its control.
    • Users must comply with all applicable data protection laws when accessing or sharing reports.

 

  1. Intellectual Property
    • The App, including its design, reporting framework, and compliance tracking system, is the exclusive property of REDLINE Fire Watch.
    • Users are granted a limited, non-exclusive, revocable license to use the App for fire watch compliance purposes.
    • Unauthorized reproduction, modification, or distribution is strictly prohibited.

 

  1. Limitations of Liability
    • The App is provided “as is” and “as available”, without warranties of any kind.
    • REDLINE Fire Watch is not liable for:
      • User errors, including failure to submit accurate reports.
      • Missed fire watch patrols or regulatory violations caused by user negligence.
      • System outages, third-party malfunctions, or external disruptions.
    • In no event shall REDLINE Fire Watch’s liability exceed the amount paid (if applicable) for services rendered in the preceding three months.

 

  1. Account Suspension or Termination
    • Accounts may be suspended or terminated without prior notice for:
      • Failure to submit accurate fire watch reports.
      • Tampering with data, falsifying records, or attempting to circumvent compliance tracking.
      • Unauthorized access or misuse of the App. 

 

  1. Modifications to These Terms
    • REDLINE Fire Watch reserves the right to update these Terms periodically. Changes will be effective upon posting within the App or on our website. Therefore, it is highly recommended that you check these Terms periodically.
    • Continued use of the App after updates signifies acceptance of the revised Terms.

 

  1. Governing Law & Dispute Resolution
    • These Terms are governed, construed and interpreted by the laws of the State of Florida, without regard to conflict of law principles.
    • Disputes arising under these Terms shall be resolved through binding arbitration in Pasco County Florida, unless otherwise required by law. The decision of the arbitrator will be final and the prevailing party must be reimbursed for any of the legal fees and overall costs related to the arbitration.
